Terms of Service (AGB)
1. Scope of Application
These Terms of Service (AGB) apply to all contracts concluded via the website spamsense.de between us (the provider) and you (the customer) regarding the purchase and use of the "SpamSense" software.
2. Conclusion of Contract
The presentation of the software on the website does not constitute a legally binding offer. The purchase contract is concluded when you complete the order process via our payment provider Stripe and the payment has been successfully authorized. You will then receive a confirmation and the download link.
3. Prices and Payment Terms
All stated prices are final prices in Euro. Due to the small business status according to § 19 UStG (German VAT Act), we do not charge value added tax and therefore do not display it. Payment is made as a one-time payment via Stripe. There are no monthly or annual subscription costs.
4. License and Terms of Use
With the purchase, you receive a simple, non-transferable and perpetual ("lifetime") license for the current major version of the software. This license entitles you to use it on exactly one (1) computer (single-device license). Resale, rental, publication, or decompilation (reverse engineering) of the software is strictly prohibited.
5. Warranty and Limitation of Liability
The SpamSense software offers the best possible protection against spam and phishing according to current technology standards. However, since cyber threats are constantly changing, a 100% detection rate cannot be technically guaranteed. We are only liable for intent and gross negligence. We assume no liability for data loss, business interruptions, or damages caused by undetected malware, as far as this is legally permissible.
6. Right of Withdrawal for Digital Content
Since SpamSense is digital content that is not delivered on a physical data carrier, your right of withdrawal expires prematurely if we have begun to execute the contract (provision of the download link or license key) after you have expressly agreed that we begin execution before the expiry of the withdrawal period and you have confirmed your knowledge of the loss of your right of withdrawal.
7. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms of Service be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by statutory provisions.
