1. Scope of Application

These Terms of Service (AGB) apply to all contracts concluded via the website spamsense.de between us (the provider) and you (the customer) regarding the use of the "SpamSense" software.

2. Conclusion of Contract

The purchase contract for SpamSense is concluded exclusively via the Apple Mac App Store in accordance with the conditions applicable there (Apple Media Services Terms and Conditions). Our website serves solely for information and linking to the official App Store.

3. Prices and Payment Terms

Payment is made as a one-time payment directly via your Apple ID account. There are no monthly or annual subscription costs. The price shown in the Mac App Store is the final price.

4. License and Terms of Use

With the purchase, you acquire the right of use in accordance with Apple's standard licensing terms (EULA). You are entitled to install and use SpamSense on all Mac computers that are linked to your personal Apple ID. In addition, Apple Family Sharing is enabled for this app. Resale or decompilation (reverse engineering) of the software is prohibited.

5. Warranty and Limitation of Liability

The SpamSense software offers the best possible protection against spam and phishing according to current technology standards. However, since cyber threats are constantly changing, a 100% detection rate cannot be technically guaranteed. We are only liable for intent and gross negligence. We assume no liability for data loss, business interruptions, or damages caused by undetected malware, as far as this is legally permissible.

6. Right of Withdrawal

Since the purchase is processed via the Apple Mac App Store, exclusively Apple's policies apply to returns and refunds. Refund requests must be submitted directly via the "Report a Problem" feature in your Apple account.

7. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms of Service be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by statutory provisions.
